Three Score and Ten in Retrospect
foreman smiles and puts up his watch: "Well, gentlemen, what do we say? Plaintiff; Defendant; Gentlemen? I rather think, so far as I am concerned, gentlemen - I say I rather think, but don't let that influence you - I rather think the plaintiff's the man." Perhaps there is a grain of truth in the implications of ridicule for the reasons sometimes used by jurors to reach a verdict, but after having submitted causes, inconsequential and important, I am impressed that man has devised no better way of settling his controversies than submitting them under proper instruction to a panel of his peers. We live in troubled times. Where does the right to protest end and the duty to conform begin? In what ways must the necessity of unity for survival curb individual license? At what point does taxation become confiscation? Where in the interest of public good must the economies of big business yield to opportunity for the beginner or the small independent operator. These questions are not new but they are posed in a new setting. A fading generation poses them to you with many more not fully answered. May you meet them with stability and vision. Within your office, be it modest or pretentious, compensation will be made for injuries, disputes will be settled, friends may be re-made, and families reunited, all without the aid of courts. Every lawyer is a judge. The courts are all too often the forum of the stubborn and the unreasonable. Conferring of the degree of Juris Doctor carries with it no omnipotent power. Beyond the h i s of justice l i e a royal purple range of mercy borne of the upheavals in man's weaknesses and imperfections, but extending peaks of wisdom and understanding. From these heights we see through compassion's eyes a clearer view with promise of a better day.
