Three Score and Ten in Retrospect
Circuit acting as chief Judge, the Honorable Leon R. Yankwich, United States District Court Judge from Los Angeles California and the Honorable James A. Walsh, District Judge from The United States District Court of Arizona, convened at Prescott, Arizona September 26th, 1960, in the United States District Court in the Federal Building in that City. The trial continued for four weeks. The Navajo counsel and aids occupied an entire floor of the largest hotel in Prescott, the Hassyampa Hotel. Since the Hopi had no funds and Mr. Boyden was financing the Hopi presentation, John, Bryant Croft and Allen Tibbals, and his wife Jane (she had been asked to come to keep house and cook for the team representing the Hopi) were housed at the Apache Motel in one two-room suite which had a very small kitchen and one other double room. The suite was occupied by the Tibbals, and John and Bryant occupied the double room. The opening day of the trial the Navajo entourage showed up at the Courthouse with an entire moving crew, several assistants and two principal attorneys, Norman Littell of Washington, D.C., chief counsel for the Navajo, and assistant Joseph McPherson. The subordinates wheeled in several file cabinets which were lined up at the back of the court room. Mr. Littell in his opening statement pointed out the "overwhelming" nature of the evidence which the Navajo had to present, pointing to the file cabinets. The Hopi had carried in a few cardboard boxes containing exhibits and the carefully worked out condensations of exhibits which Mr. Boyden had planned. The condensations and the boxes of evidence prepared by counsel for the Hopi were much used in the course of the trial. The multitudinous fie cabinets of the Navajo remained essentially untouched throughout the four week trial. The daily routine of counsel for the Hopi became established: up at 6:00 a.m. or earlier, breakfast at the Tibbals quarters at 7:00; discuss the evidence and examine any documents typed or prepared the night before, (Allen Tibbals was the typist and had brought along his L. C. Smith Corona Sterling Portable on which all the documents prepared in Arizona for the trial, and there were several, were typed); be at Court by 9:30 a.m.; adjourn for lunch at noon; return to the motel for lunch which had been prepared by Jane Tibbals; be back in Court by 1:30 p.m.; continue with the trial all afternoon, adjourning
